P3 FITNESS — PARENT / GUARDIAN AGREEMENT, ASSUMPTION OF RISK AND RELEASE OF LIABILITY Please read this before you sign it. It affects your legal rights and your child's. It is written to be understood, not to be confusing. If any part of it isn't clear, ask us before you sign. WHO THIS AGREEMENT IS BETWEEN This agreement is between you — the parent or legal guardian signing below — and P3 Fitness, together with its owners, coaches, employees, volunteers and helpers (together, "P3"). "Athlete" means each child you are registering. 1. WHAT WE DO AND WHERE P3 runs youth athletic training, obstacle course racing (OCR) training, and fitness classes outdoors at Weston Hills Park, 950 Weston Ridge St, Henderson, Nevada 89011, and at other locations we tell you about in advance. Sessions are coached, but they are physical, and they happen outdoors in a public park that other people are also using. 2. THE RISKS I UNDERSTAND AND ACCEPT I understand these activities carry real physical risk. Specifically, and this is not a complete list: • running, sprinting, jumping, climbing, hanging, crawling, carrying and lifting; • obstacles, walls, ropes, bars, rigs, weights, sleds, cones and other equipment; • uneven, rocky, sandy, wet or slippery ground, curbs, steps and park furniture; • heat, sun, cold, wind, dust and sudden weather changes in the Las Vegas valley; • collisions or contact with other participants; • insects, animals, and other members of the public using the park; • sprains, strains, cuts, bruises, broken bones, overuse injuries, concussion and other head or neck injury, heat illness, dehydration, and cardiac events; • the possibility that a coach's instruction, supervision, judgment, spotting or first aid turns out to be imperfect. These risks can lead to minor injury, serious injury, permanent disability, or death. Knowing that, I choose to let my Athlete take part, and I expressly and voluntarily accept these risks — for my Athlete, and for myself when I am present as a parent or spectator. 3. HEAD INJURIES If a coach sees or suspects a head injury or concussion, my Athlete will be taken out of the session immediately. My Athlete may not train again until a licensed health care provider examines them and gives us a signed statement clearing them to return. I understand that continuing to train after a head injury can cause far more serious harm, and I agree not to ask a coach to override this. 4. HEALTH, MEDICAL INFORMATION AND EMERGENCIES I confirm my Athlete is in good enough health to take part, and that I have told P3 about every allergy, medical condition, injury, medication and limitation that a coach should know about. I will tell P3 promptly if anything changes. I understand P3's coaches are not doctors, nurses or athletic trainers, do not diagnose or treat, and rely on what I tell them. If my Athlete is hurt and I cannot be reached, I authorize P3 to call 911 and to arrange emergency medical care. I am responsible for the cost of that care and for my Athlete's medical bills. P3 does not carry health or accident insurance for participants. 5. WHAT I AM GIVING UP For myself, and for anyone claiming through me, I release, waive and agree not to sue P3 for any claim, demand or cause of action for injury, illness, death, or loss of or damage to property arising out of my Athlete's or my participation in P3's activities, INCLUDING A CLAIM THAT P3 WAS NEGLIGENT. This covers my own claims as a parent — for example, my claims for my Athlete's medical expenses, or for the loss of my Athlete's services or companionship. To the fullest extent Nevada law allows, I also give up these claims on behalf of my Athlete. 6. WHAT THIS DOES NOT GIVE UP This release does not, and is not meant to, excuse P3 from: • gross negligence, recklessness, or intentional or willful misconduct; or • anything Nevada law does not allow to be released in advance. You should also know this, plainly: Nevada law is protective of children, and we are not aware of any Nevada court decision holding that a parent can give up a child's own right to sue for a future injury. A Nevada court may well decide that a parent cannot. Nothing here is meant to take away a right your Athlete keeps under Nevada law, and if a court decides part of this release cannot be enforced, the rest of this agreement still stands. 7. IF MY ATHLETE OR I CAUSE A PROBLEM If my Athlete or I damage property, injure someone else, or break P3's rules in a way that costs P3 money, I will cover that cost, including reasonable attorney's fees. I am not agreeing to reimburse P3 for defending a claim brought by or on behalf of my Athlete for my Athlete's own injury. 8. RULES, CONDUCT AND SUPERVISION My Athlete will follow the coaches' safety instructions. P3 may remove anyone — athlete, parent or spectator — whose behavior is unsafe, disruptive or abusive, without a refund. I am responsible for supervising my Athlete before and after the session; coaching starts when the session starts and ends when it ends. 9. PHOTOS AND VIDEO — PLEASE READ, THIS IS A REAL PERMISSION By signing this agreement I give P3 my written consent to photograph and film my Athlete during sessions and events, and to use those photographs, videos, my Athlete's likeness, and my Athlete's first name and last initial to advertise and promote P3's services. That includes p3nvfitness.com, P3's own social media accounts, printed flyers and banners, emails to families, and paid or boosted posts. I understand this is a commercial use and I am consenting to it under Nevada's right of publicity law, NRS 597.770 to 597.810. No payment is or will be due to me or my Athlete, and I do not have a right to approve individual images before they are used. Limits P3 agrees to: P3 will not publish my Athlete's full name, age, date of birth, medical information or contact details alongside an image, and will not sell or license images to anyone else. I can withdraw this permission at any time, in writing, by emailing p3fitness.jess@gmail.com. P3 will stop using new images of my Athlete and will remove existing ones from p3nvfitness.com and from P3's own social media accounts within 10 business days. P3 cannot recall printed material already distributed, or copies other people have already saved, reposted or cached. Withdrawing this permission has no effect on my Athlete's place in any program, and I understand I may decline it now by emailing P3 before my Athlete's first session. 10. SIGNING THIS ELECTRONICALLY I agree to sign this agreement electronically. Typing my full name and checking the box has the same legal effect as signing on paper. P3 records the date and time, my IP address, and the version of this agreement I signed, and keeps a copy I can read or download at any time from my account at p3nvfitness.com/account/waivers. If I would rather sign on paper, or want a paper copy, I can email P3 and ask. 11. THE REST This agreement is governed by Nevada law, and any dispute belongs in the state courts of Clark County, Nevada. If a court finds any part unenforceable, the rest stays in force. This agreement binds my heirs and my Athlete's heirs. I confirm I am at least 18 and am the parent or legal guardian with authority to sign for each Athlete named in this registration. I HAVE READ THIS AGREEMENT. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE P3 FOR ITS OWN NEGLIGENCE. I AM SIGNING IT FREELY, AS THE PARENT OR LEGAL GUARDIAN OF THE ATHLETE(S) NAMED IN THIS REGISTRATION.
